NonstopOrder is operated by Emre Demir, a sole trader trading as NonstopOrder, ABN 16 451 345 424, Melbourne, Victoria, Australia. Contact: [email protected]. Venues that use NonstopOrder to sell to you are separate businesses; each venue's own name, ABN and contact details are on its ordering page and receipts.
Terms of Use
1. About these terms
These terms apply when you use NonstopOrder to browse venues, place orders, create an account or take part in NonstopOrder Rewards, whether on our website, a venue's ordering page or an in-store kiosk (together, the Service). "We", "us" and "NonstopOrder" mean Emre Demir trading as NonstopOrder (ABN 16 451 345 424). If the Service is transferred to a company we control, these terms continue with that company and we will tell you.
By using the Service you agree to these terms, our Privacy Policy and, if you collect points, the Rewards Terms. Businesses that use NonstopOrder to sell (venues) have separate Venue Terms.
2. Who sells you the food
NonstopOrder provides the ordering technology. The food and drink you order is sold to you by the venue (for example a food truck, caravan or café), not by us, and your contract for it is with the venue. The venue is responsible for its menu, prices, food preparation, quality, food safety, allergen information, opening hours and handing your order to you. We are responsible for running the Service with due care and skill.
3. Your account
- You can order without an account. An account lets you see past orders, save favourites and collect points.
- You must be at least 16 to create an account. If you are under 18, a parent or guardian must agree to these terms.
- Your account is linked to your mobile number and protected by a PIN. Keep it private. You are responsible for activity on your account unless it happened because we did not take reasonable care.
- Tell us at [email protected] if you think someone else has used your account.
- We may suspend or close an account used for fraud, abuse of promotions or points, or in serious breach of these terms. We will tell you why unless the law or a fraud investigation prevents it.
- You can close your account at any time from Account › Delete my account, or by emailing us.
4. Placing an order
- Menu descriptions, photos and prices are supplied by the venue. Photos are for illustration; your item may look different.
- Prices are in Australian dollars and include GST where it applies.
- Your order is placed when you see the order confirmation with its order number. The venue may still cancel it, for example if an item has sold out; if you paid by card, you are refunded in full.
- Pickup times are estimates. Delays can happen at busy times.
- Please collect your order at the time you chose. If it is not collected within a reasonable time, the venue may throw it away for food-safety reasons and it will not usually be refunded.
- Check your order before you confirm it. Once the venue has started preparing it, it may not be possible to change or cancel.
5. Paying
- Each venue chooses how you can pay: at its kiosk by card, at the counter when you collect, or online by card where the venue offers it.
- Card payments are processed by Tyro Payments Limited for the venue. You enter your card on Tyro's own payment form or terminal; NonstopOrder never sees or stores your full card number or security code.
- For online card payment, your order is placed only once the payment is approved. If a payment fails or is cancelled, no order is placed and nothing is charged.
- For pay-at-counter orders, you pay the venue when you collect.
- Since 1 October 2026, businesses in Australia may not add a surcharge for paying by eftpos, Mastercard or Visa debit or credit cards, and American Express has also removed surcharging. If a surcharge was added to your payment, please tell the venue or us.
6. Refunds and problems with an order
See Refunds below. In short: the venue decides refunds for food, you have rights under the Australian Consumer Law that nobody can take away, and we will help you reach the venue.
7. Acceptable use
Please do not misuse the Service, including by placing fake or fraudulent orders, using someone else's account or card without permission, interfering with the Service's security, scraping or copying it by automated means, or harassing venue staff through it.
8. Intellectual property
The Service, its software and design belong to or are licensed to NonstopOrder. Venue names, logos, menus and photos belong to the venue or its licensors. You may use the Service only to place and manage your own orders.
9. Third-party services
The Service relies on other providers, including Tyro (payments), Twilio (text messages), our email provider and cloud hosting. We choose them with care. We are not responsible for their outages that are outside our reasonable control, but this does not limit your rights under the Australian Consumer Law.
10. Availability
We aim to keep the Service available but it may sometimes be unavailable for maintenance or for reasons outside our control. Venues can pause online ordering at any time, for example when they are busy or closed.
11. Your consumer rights and our liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have under that law.
Subject to those rights and to the extent the law allows: the venue, not NonstopOrder, is responsible for the food and drink it supplies; where our liability for failing to meet a consumer guarantee can lawfully be limited, it is limited to supplying the service again or paying the cost of having it supplied again; and we are not liable for loss that was not reasonably foreseeable. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence.
12. Changes to these terms
We may update these terms, for example for new features or changes in the law. The date at the top shows the current version. For a change that materially affects you, we will tell you in the Service or by email at least 14 days before it takes effect, and you can close your account if you do not agree. Orders already placed stay under the terms that applied when you placed them.
13. Complaints
Contact [email protected]. We aim to reply within 5 business days. If we cannot resolve it, you can contact your state or territory consumer protection agency (in Victoria, Consumer Affairs Victoria).
14. Governing law
These terms are governed by the laws of Victoria, Australia. Nothing in this clause stops you relying on consumer protection laws where you live.
Privacy Policy
This policy explains how Emre Demir trading as NonstopOrder (ABN 16 451 345 424) collects, uses, discloses and protects personal information. We handle it in line with the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth), and we apply them to everyone who uses the Service, whether or not the law requires it of a business our size.
1. What we collect
| When you order | The name you give for collection (optional at a kiosk), what you ordered, the venue, pickup time, total and how you paid. For online orders, a mobile number if you choose to give one, so the venue can text you when it is ready. |
|---|---|
| Order notes | Anything you type in a note. If you mention an allergy or dietary need, that is health information: you choose to give it, and we use it only so the venue can prepare your order. |
| Account | Mobile number, first and last name, email address (optional unless you sign in by email) and your PIN, which we store only in scrambled (hashed) form. Whether you agreed to offers, and when. |
| Rewards | Points earned, spent and expired, and the venues where that happened. Venues you save as favourites. |
| Payments | Tyro handles your card. We receive the result and limited details such as the card type, last digits and approval reference. We never receive your full card number or security code. |
| Notifications | If you turn on "tell me when it's ready", a push-notification address created by your browser and which order or account it belongs to. |
| Contact form | Name, email, phone (optional), business name and type, your message, and the IP address and browser it came from (kept 90 days, to stop spam). |
| Venue businesses | Business and contact details of venues and their staff, dashboard sign-in details, and billing details held by Stripe (see Venue Terms). |
| Technical | IP address, browser and device type, and error logs, collected automatically to run and secure the Service. |
We do not collect your date of birth or your location. You can order with a first name or nickname, and without an account. The Service is not designed for children under 16, and we do not knowingly create accounts for them.
2. How we collect it
Mostly from you, when you order, create an account or contact us. Some comes from the venue (for example when staff enter an order for you), from Tyro (payment results) and from your device automatically. Kiosks and kitchen screens send us a screenshot only when venue staff or NonstopOrder support take one to fix a problem; it can show customer first names and is deleted within 24 hours.
3. Why we use it
- to pass your order to the venue so it can make it and hand it to you, and to tell you when it is ready;
- to process payments and refunds, prevent fraud and keep accounts secure (including sign-in codes by text or email);
- to run NonstopOrder Rewards;
- to send receipts and messages about your orders and account;
- to answer enquiries, provide support and handle complaints;
- to keep the Service working, secure and improving; and
- to meet our legal obligations, such as tax records.
4. Offers by text or email
We, and venues you have bought from, send offers only if you have agreed. Agreeing is optional, is never a condition of ordering, and is recorded with the date. Every offer identifies who sent it and includes a free, working way to unsubscribe; we act on it within 5 business days. A venue can only send offers to people who have ordered from it or joined its rewards, never to customers of other venues. Messages about your own orders and account are not offers and are still sent.
5. Who we share it with
- The venue you order from: your collection name, order and notes. If you have an account and have ordered from or joined that venue, it can also see your name, mobile, email, whether you agreed to offers, and your points there. Other venues cannot see you.
- Service providers that run parts of the Service for us and may use the information only for that: Tyro Payments (card payments); Twilio (text messages); our email delivery provider; Railway (application hosting and database); Cloudflare R2 (encrypted backups and menu images); Stripe (billing venues for NonstopOrder); Anthropic (the venue owner's dashboard assistant: it receives the owner's request as text, menu items and sales totals, never customer contact details); and the push services of Apple, Google or Mozilla, which carry encrypted notifications to your browser. If a venue owner speaks to the dashboard assistant, the recording is turned into text on our own server; where that is switched to OpenAI's speech service, or the owner's browser does its own speech recognition (for example Chrome), OpenAI or the browser maker processes that audio. Assistant recordings never contain customer details.
- Square, only where a venue connects its Square counter: we import sales from Square, we do not send your details to it.
- Authorities where the law requires or allows it, or to prevent fraud or serious harm.
We do not sell personal information and we do not share it with advertisers.
6. Overseas
Our application and database are hosted by Railway in the United States. Our other providers above may store or process information in the United States and other countries, including the European Union. We take reasonable steps, including through our contracts with them, to make sure they handle it consistently with the APPs.
7. Automated decisions
We do not use automated processes to make decisions about customers that significantly affect them. For venue businesses: if a NonstopOrder subscription payment is still unpaid 14 days after it was due, and after reminders, ordering at that venue is paused automatically, at its next closing time, until it is paid. The program uses only the venue's subscription payment status, due date, amount owing and opening hours. Any venue can ask a person to review it at [email protected].
8. How we protect it
Encrypted connections (HTTPS), PINs stored only in hashed form, encrypted backups, access limited to people who need it, and providers with recognised security practices. No system is completely secure, but we take reasonable steps to protect information from misuse, interference, loss and unauthorised access.
9. How long we keep it
| Orders and payments | Order totals are kept for venues' tax records. After 7 years, names, numbers and notes are removed from them automatically. If you delete your account, your name, number and notes are removed from finished orders straight away, and from any order still being made the next day. |
|---|---|
| Account | While it is open. When you delete it, we erase your name, mobile, email and PIN immediately and your points are cancelled. Copies in our encrypted backups are gone within 30 days. |
| Payment notifications from Tyro | 400 days, to deal with card disputes; after that only the payment result is kept. |
| Sign-in codes | 7 days. |
| Contact form | The enquiry for as long as we are in contact; the IP address and browser details 90 days. |
| Device screenshots | 24 hours. |
| Assistant transcripts (venue owners) | 90 days. |
| Backups | 30 days, encrypted. |
10. Access, correction and deletion
You can see and change your details under Account, and delete your account there. You can also ask us for a copy of, correction of or deletion of the personal information we hold about you at [email protected]. We will reply within 30 days and will not charge you.
11. Data breaches
If a breach of your information is likely to cause you serious harm, we will tell you and the Office of the Australian Information Commissioner (OAIC) as soon as we can.
12. Complaints
Contact [email protected]. We will respond within 30 days. If you are not satisfied, you can complain to the OAIC at oaic.gov.au or 1300 363 992.
13. Changes
We will update this policy when what we do changes. The version date at the top shows the latest.
Cookies & Storage
NonstopOrder does not use advertising or analytics cookies, tracking pixels or similar tools, and does not track you across other websites. Because everything below is needed for the Service to work, we do not show a cookie banner. If we ever add analytics or advertising tools, we will update this page first and ask for your agreement where that is required.
What the Service stores in your browser
| Signed-in session | Keeps you signed in to your account, or venue staff to the dashboard. Removed when you sign out. |
|---|---|
| Basket | Remembers your basket on a venue's ordering page for a few hours, and the details of an order while you pay. |
| Preferences | Small choices such as whether you dismissed a tip, turned on notifications, or which language the dashboard assistant uses. |
| Kiosk and kitchen screens | On venue devices only: which dockets have printed and recent card transactions, so nothing prints or charges twice. |
| Offline copy | A copy of the app's own files so pages open quickly and keep working on a poor connection. |
Other providers
When you pay by card, Tyro's payment form may set its own cookies to process the payment and prevent fraud; venues paying their subscription use Stripe's pages, which do the same. Their policies apply to those cookies. Pages may load small code libraries from Cloudflare's cdnjs service, which receives your IP address as part of the request.
Your choices
You can clear this storage in your browser settings at any time. You will be signed out and your basket emptied.
Refunds
Food and drink orders
- The venue sells you the food, so it decides refunds for orders. Each venue's own refund details are on its ordering page under "Policies". Tell staff straight away if something is wrong when you collect.
- If the venue cancels your order, for example because an item sold out, you get a full refund to the card you paid with.
- Refunds for change of mind are not generally available, but a venue may choose to give one.
- Card refunds go back to the same card, usually within 3–5 business days depending on your bank.
- Points earned on a refunded or cancelled order are removed. Points spent on a reward order the venue cancels are returned.
- Need help reaching a venue? Email [email protected] with your order number and we will pass it on.
Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
Venue subscriptions
Refunds of NonstopOrder subscription fees for venues are covered in the Venue Terms.
Rewards Terms
NonstopOrder Rewards is run by NonstopOrder with the venues that take part.
1. Joining
Membership is free. You need a NonstopOrder account (your mobile number and a PIN). You can join online, at a kiosk, or when you claim points from a receipt.
2. One balance across venues
Your points are kept in one balance. Points earned at one participating venue can be redeemed at any participating venue, for the rewards that venue offers. Each venue's rewards and earning rate are shown on its ordering page and kiosk.
3. Earning
- You earn points at the rate the venue shows at the time (for example 1 point for every $1), on the amount you actually paid for a completed order.
- Points are not earned on reward orders, cancelled or refunded orders. If an order is refunded, the points earned on it are removed, as far as you have not already used them.
4. Redeeming
- Rewards depend on availability and the venue being open. A reward is prepared for collection at that venue.
- Points come off when you place the reward order. If the venue cancels it, the points are returned.
- Points and rewards are not money. They cannot be exchanged for cash, sold or transferred to someone else.
5. Expiry
Points expire 90 days after you earn them unless the venue where you earned them shows a different period. When you redeem, the points closest to expiring are used first. Expired points cannot be restored.
6. Your account
One account per person and mobile number. Keep your PIN private. We may remove points or close a membership used fraudulently or shared between people. Points are cancelled if you delete your account.
7. Changes and ending
Each venue sets and may change its own earning rate and rewards at any time; points you already hold keep their expiry date. We will give at least 30 days' notice in the Service before the programme ends, or before a change to these terms that reduces the value of points you already hold, so you can use them. If a venue leaves the programme, your points stay in your balance for the other participating venues.
8. Your rights
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law.
Allergy Information
If you have a severe food allergy, speak to the venue's staff before ordering.
Where the information comes from
Menu descriptions and any allergen information are supplied by each venue. NonstopOrder does not prepare food and cannot check the ingredients or allergen content of any item.
Cross-contact
Most venues prepare many foods in the same kitchen, often with shared equipment, oil and surfaces. Even when an item does not contain an allergen as an ingredient, venues cannot guarantee it is free from traces of common allergens: peanut, tree nuts (almond, Brazil nut, cashew, hazelnut, macadamia, pecan, pine nut, pistachio and walnut), sesame, milk, egg, soy, wheat and gluten, fish, crustacea, molluscs and lupin.
Order notes
You can add allergy information in your order notes. The venue will see the note, but a note is not a guarantee your request can be met. If it matters for your health, confirm with staff when you collect.
Ask the venue
Under the Australia New Zealand Food Standards Code, food businesses must be able to tell you about allergens in the food they sell. Ask the venue's staff, or email [email protected] and we will pass your question on.
